Full Journal pdf2010-03-24 House Journal Page 1863 HB 280 The following, which was advanced to third reading from the March 23, 2010, calendar (page 1839), was read the third time: CS FOR HOUSE BILL NO. 280(FIN) "An Act relating to a gas storage facility; relating to the Regulatory Commission of Alaska; relating to the participation by the attorney general in a matter involving the approval of a rate or a gas supply contract; relating to an income tax credit for a gas storage facility; relating to oil and gas production tax credits; relating to the powers and duties of the Alaska Oil and Gas Conservation Commission; relating to production tax credits for certain losses and expenditures, including exploration expenditures; relating to the powers and duties of the director of the division of lands and to lease fees for a gas storage facility on state land; and providing for an effective date." The Finance Committee submitted the following forthcoming fiscal note to accompany its report (page 1813): 2010-03-24 House Journal Page 1864 5. Zero, House Finance Committee/Dept. of Revenue Representative Petersen moved and asked unanimous consent that CSHB 280(FIN) be returned to second reading for the specific purpose of considering Amendment No. 1. There being no objection, it was so ordered. Amendment No. 1 was offered by Representatives Petersen, Kerttula, Crawford, Tuck, Gara, Holmes, Kawasaki, Gardner, Gruenberg, Cissna, Guttenberg, N. Foster, and Buch: Page 1, line 2, following "Alaska;" (title amendment): Insert "requiring the Regulatory Commission of Alaska to require a reduction in costs attributable to the application of certain tax credits when determining rates;" Page 6, line 31: Delete "a new subsection" Insert "new subsections" Page 7, following line 10: Insert a new subsection to read: "(e) In the establishment of rates to be paid by a consumer or customer under this chapter, the commission shall require that the reduction in costs attributable to credits authorized by AS 43.20.046 and AS 43.55.023 be used to reduce a rate determined by the commission. A credit under AS 43.55.023(a) for a qualified capital expenditure incurred in the Cook Inlet sedimentary basin or AS 43.55.023(m) for a Cook Inlet well lease expenditure shall be applied when determining the reduction in costs attributable to the credits, regardless of whether the credits were applied to a tax levied by AS 43.55.011(e) on a producer for oil or gas produced in the Cook Inlet sedimentary basin." Representative Petersen moved and asked unanimous consent that Amendment No. 1 be adopted. Representative Gara moved and asked unanimous consent that CSHB 280(FIN) be returned to second reading for the specific purpose of considering Amendment No. 2. There being no objection, it was so ordered. Amendment No. 2 was offered by Representatives Gara and Hawker: Page 9, line 31: Delete "$15,000,000" Insert "the lesser of $15,000,000 or 25 percent of the costs incurred to establish the gas storage facility" Representative Gara moved and asked unanimous consent that Amendment No. 2 be adopted. Representative Hawker objected and withdrew the objection. There being no further objection, Amendment No. 2 was adopted.
